Terms and Conditions

 

Background to Promotion

1. Mirvac Victoria Pty Ltd (ABN 42 006 708 363) of Level 8, 1 Southbank Boulevard, Southbank VIC 3006 (Mirvac or the Promoter) recently introduced the Save up to 50% on Stamp Duty (up to the value of $30,000) (Promotion) at The Fabric by Mirvac.  

 

2. The Promotion will run for a limited time. The Promotion commences at 9:00am on Friday 28th February 2025 and ends at 5:00pm on Monday 30th June 2025 (Promotion Period).

 

3. On 21 October 2024, the Victorian Government announced a new temporary off-the-plan transfer stamp duty concession which is available for off-the-plan dwellings within strata subdivisions that have common property.  Mirvac has introduced this Promotion for Stage 4 townhomes at The Fabric by Mirvac which are not strata subdivisions (and not subject to Owners Corporation fees) and not eligible for the temporary Government stamp duty concession, in order to help customers with their stamp duty liability.

4. Under the Promotion, an Eligible Buyer (as defined in condition 5) who purchases an available Stage 4 townhome at The Fabric by Mirvac (as listed at the end of these conditions being the Eligible Lots) during the Promotion Period will be: 

     a. entitled to a contribution at settlement by Mirvac of up to 50% of an Eligible Buyer’s stamp duty liability capped at $30,000; and 
     b. entitled to pay a reduced deposit in the amount of $20,000 
subject to these terms and conditions.

5. The following terms and conditions apply to the Promotion. By participating in the Promotion, Eligible Buyers agree to be bound by these terms and conditions.

 

Promotion Terms and Conditions

The Eligible Buyer will only be entitled to take part in the Promotion if the following terms and conditions are satisfied: 
6. The Promotion is for buyers who: 


     a. are natural persons over the age of 18 years and are not a company, registered builder, superannuation funds or persons acting as agent on behalf of other persons;
     b. have not been referred to Mirvac or The Fabric by Mirvac by a referring channel agent;
     c. are not an employee, agent, consultant or related entity of Mirvac; and
     d. enter into an unconditional contract of sale with Mirvac for the purchase of an Eligible Property (Contract) during the Promotion Period.

7. Reduced Deposit: Mirvac will accept a reduced deposit of $20,000 under the Contract for the purchase of an Eligible Lot provided the Eligible Buyer enters into the Contract during the Promotion Period.

 

8. Promotion Contribution: Subject to paragraph 10, Mirvac will contribute an amount equal to the lesser of $30,000 and 50% of the stamp duty payable by the Eligible Buyer on the acquisition of the Eligible Property under the Contract (Promotion Contribution) provided that the Eligible Buyer:

     a. pays the Reduced Deposit on or before the date required by the Contract; 
     b. complies with the terms of the Contract and is not otherwise in default under the Contract; and
     c. settles the acquisition of the Eligible Lot on the due date for settlement as required under the Contract. 

 

 

9. Provided the Eligible Buyer complies with the conditions in clause 8, the Promotion Contribution will be provided in the following manner:

     a. part of the purchase price payable under the Contract to Mirvac at settlement will be directed to the Victorian State Revenue Office in full satisfaction of the Purchaser’s stamp duty liability in respect of the acquisition of the Eligible Lot under the Contract; and
     b. the price payable under the contract will be adjusted at settlement of the Contract in favour of the vendor under the Contract for an amount equal to the Eligible Buyer’s stamp duty assessment in respect of the acquisition of the Eligible Lot LESS the Promotion Contribution.

 

 

10. Despite anything to the contrary in these terms and conditions or the Contract, the Promotion Contribution is calculated based on an Eligible Buyer’s stamp duty liability for acquisition of the Eligible Lot excluding any Surcharge Purchaser Duty (as defined in the Duties Act 1997 (VIC) for which the Eligible Buyer may be liable for. 

 

11. The Eligible Buyer must disclose the contents of this Promotion to any lending institution providing finance to the Eligible Buyer to assist with the purchase of the Property and Mirvac is not liable for any assessment of this Promotion made by the lending institution which may consequently affect the total amount which the lending institution is prepared to finance or loan to the Eligible Buyer.

 

12. Mirvac does not make any warranty as to the amount of duty payable on the transfer of the Property to the Eligible Buyer and the Promotion Contribution is in no way representative of the amount of duty payable on the transfer of the Property to the Eligible Buyer.

 

Further Terms and Conditions of Promotion

The following additional terms and conditions also apply to the Promotion:


13. The Eligible Buyer acknowledges and agrees that the Promotion is non-transferrable, non-refundable and cannot be exchanged for cash.  All taxes which may be payable as a consequence of receiving or participating in the Promotion are the sole responsibility of the Eligible Buyer.


14. The Eligible Buyer forfeits all rights to receiving or participating in the Promotion if the Eligible Buyer does not comply with any of these terms and conditions or any term or condition under the Contract.  


15. This Promotion cannot be used in conjunction with any other promotion or campaign promoted by Mirvac.


16. To the extent permitted by law, Mirvac is not liable to the Eligible Buyer for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with the Eligible Buyer’s participation in this Promotion even if Mirvac has been advised of the possibility of such damages.


17. Prior to an Eligible Buyer’s entry into the Contract, Mirvac reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Promotion at any time without notice.


18. If there is any inconsistency between these terms and conditions and the provisions of the contract of sale entered into by a person participating in the Promotion, the contract of sale prevails.


19. These terms and conditions are governed by the laws of VIC.

20. The Mirvac Group (Mirvac Limited and its controlled entities) collects and uses personal information about you to promote its products and services and may disclose personal information to third parties agents and services providers. Mirvac also uses your personal information for related purposes including to request your feedback on the products and services provided by Mirvac. If you do not provide all the personal information Mirvac requests from you, Mirvac may be unable to provide these products or services to you.


21. Mirvac may disclose personal information about you to third party agents and service providers to assist Mirvac in the operation of its business to provide the products and services you request. Your personal information may also be disclosed to overseas recipients who use the personal information to assist Mirvac in the operation of its business in countries including, but not limited to, the United States of America, the Philippines, Japan and United Kingdom.


22. 23. By participating in the Promotion, you agree to Mirvac using your personal information to promote its products and services. If you no longer wish to receive promotional information from Mirvac, you may advise Mirvac of your wish.
